Terms of Use

These terms are a contract between you and Polarys Lab ("Lofty", "we", "us"). By creating an account or using the app, you agree to them. If you do not agree, please do not use Lofty.

1. Who can use Lofty

You must be at least 17 years old and able to enter a binding contract. You are responsible for the accuracy of the details you give us and for keeping your sign-in secure.

2. What Lofty is

Lofty is a focus timer presented as a flight. It helps you set aside time for tasks. It is a wellbeing and productivity tool. It is not a medical device or a treatment and does not diagnose, treat, cure or prevent any condition. If you have concerns about your health or attention, please speak with a qualified professional.

3. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own use, under these terms and the rules of your app store.

You may not copy, modify, reverse engineer, resell or build competing services from the app, except where the law says you may. You may not bypass or attack our security, scrape or overload our systems, or use the app to harm others.

4. Subscriptions, free trials and billing

• Lofty is a paid service with a free trial. Plans, prices and renewal periods are shown in the app before you buy. Prices may vary by country and tax.
• Free trial: one free trial per person. When it ends, your subscription starts automatically at the price shown unless you cancel at least 24 hours before the end of the trial.
• Renewal: subscriptions renew automatically at the end of each period (weekly, monthly or yearly) until you cancel.
• Payment and cancellation: payments are taken by Apple or Google, so you manage and cancel your subscription in your Apple ID or Google Play settings. Deleting the app does not cancel it.
• Refunds: refunds are handled by Apple or Google under their policies. We cannot refund purchases made through them, but we will help where we can.
• Price changes: if the price changes, we will tell you in advance and you can cancel before it applies.
• Lifetime plans (if offered) give access to the paid features for the life of the app, not for your lifetime. If we stop operating the service, we will give at least 90 days of notice.
• When your subscription ends, you keep read-only access to your flight log. Other features need an active plan.

5. Your content

You own the task text, planner entries and anything else you put into Lofty. You give us a limited licence to store and process it to run the service. Do not put in content that is unlawful, harmful or infringes someone's rights.

6. Fly Together and friends

Share your invite code only with people you know. You are responsible for who you accept. You can remove or block a friend at any time. We may remove accounts that harass or abuse others.

7. Notifications and permissions

Some features need permissions (notifications, Screen Time, usage access, overlay). They are optional, and you can change them in your phone's settings.

8. Third-party services

Lofty relies on services from Apple, Google, Mapbox, Supabase, RevenueCat and others. Their terms apply to their services. We are not responsible for them.

9. Our property

The app, the Lofty name and logo, the stamps, illustrations, sounds, narration and text belong to us or our licensors. These terms do not give you ownership of them. Share cards and stamps you create may be shared socially for personal use.

10. Availability and changes

We work hard to keep Lofty running, but we do not promise it will always be available or error free. We may change or remove features, and we will give notice of changes that materially affect paid features.

11. Disclaimers

The app is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including fitness for a particular purpose. We do not guarantee that using Lofty will improve your focus or any outcome.

12. Limit of liability

To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost data, or lost profit. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or USD 50 if you paid nothing. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud. Consumer rights in your country are not affected.

13. Ending your account

You can delete your account at any time in the app (You tab, Privacy and data). We may suspend or end your access if you break these terms or misuse the service. Sections that by their nature should continue to apply will continue after the account ends.

14. Changes to these terms

If we change these terms in a way that matters, we will tell you before it takes effect. If you keep using the app afterwards, you accept the new terms.

15. Governing law

These terms are governed by the laws of Malaysia, and its courts have jurisdiction, except that if you are a consumer you keep any rights you have to use your local courts and mandatory local law.

16. Apple and Google

If you downloaded Lofty from the Apple App Store, you acknowledge that these terms are between you and us, not Apple. Apple has no duty to provide maintenance or support, is not responsible for claims relating to the app, and is a third-party beneficiary of these terms with the right to enforce them against you. Apple's standard licensed application end user licence agreement also applies. If you downloaded from Google Play, Google's terms for Play also apply.
